LightPocket, Inc. ("LightPocket" or "We") offers you the ability to rent items ("Rental Items" or "Items") subject to the following conditions ("Rental Terms"). If you choose to rent an item through LightPocket, you accept the Rental Terms. Please read them carefully.

You acknowledge and agree that LightPocket reserves the right to limit the number of Rental Items that you may rent at any given time. You may rent Rental Items for the rental periods designated by LightPocket ("Rental Periods"). You agree to inspect the Rental Items for integrity upon receipt and to notify us immediately in case a defect is detected.

By renting an item through LightPocket, you are agreeing to return it on or before the Rental Due Date. "Rental Due Date" is specified in the confirmation email or the rental application form sent by us and may be changed by your extension requests.

You may extend the Rental Period of Items by paying additional extension fees. You are responsible for requesting an extension over online before the Rental Due Date.

You agree to pay all fees and applicable taxes charged to you in connection with Rental Items with a valid credit card accepted by LightPocket (currently Visa, MasterCard, and American Express). You won't provide any fraudulent, misleading, or inaccurate credit card information. To rent an item, your credit card may not expire earlier than thirty (90) business days after the end of the applicable Rental Period.

Rental Items can only be used in a careful and proper manner and shall not be used in any way that is inconsistent with instructions or manuals.

You're solely responsible for being aware of Rental Due Dates. You agree to return each Rental Item by following the procedure designated by LightPocket. You're responsible for properly packing each Rental Item to avoid damage during shipping. Any Rental Item that isn't shipped by or on the Rental Due Date will incur late fees as described below.

You agree that LightPocket reserves the right to charge your credit card on file the following amounts if you:
return the wrong Item in place of the Rental Item that LightPocket asked you to return (a "Wrong Item");
fail to return any Rental Item (including any related supplements that you received);
or return the Rental Item after the Rental Due Date (the date of shipping, as evidenced by your postmark or shipping receipt, will be deemed the date of return).

You shall indemnify, defend and hold harmless LightPocket from and against any claim, demand, cause of action, loss or liability (including attorney fees and expenses of litigation) for any property damage or personal injury arising from your use of Rental Items by any cause, except to the extent caused by our gross negligence or willful misconduct. IN NO EVENT SHALL LightPocket BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES ARISING FROM YOUR USE OF RENTAL ITEMS, INCLUDING BUT NOT LIMITED TO LOSS PROFITS AND LOSS REVENUE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

The Rental Terms shall be governed by the laws of Japan, and the Tokyo District Court shall have exclusive primary jurisdiction with respect to all disputes arising with respect thereto.
